Terms of Service

The terms that govern your use of VideoUpscaler: accounts, credits and payments, acceptable use of the service, intellectual property and limits of liability.

These Terms of Service ("Terms") are an agreement between you and SailorFlow LLC, a Wyoming limited liability company with its office at 30 N Gould St Ste R, Sheridan, WY 82801, USA, which operates VideoUpscaler and videoupscaler.co ("VideoUpscaler", "we", "us"). By creating an account or using the service you accept these Terms and our Privacy Policy. If you do not agree, do not use the service.

1. The service

VideoUpscaler is an online tool that uses AI models to upscale and enhance video files to 1080P, 2K or 4K. You upload a video, choose an output resolution, we process it on cloud GPU servers, and you download the result. Processing is automated; the quality of the result depends on the source material, and we do not guarantee any specific outcome.

We may change, add or remove features, supported formats, file limits and processing behaviour at any time to keep the service working and improving.

2. Accounts

You must be at least 16 years old, or the age of majority where you live, to use the service. You are responsible for the security of your account and for everything that happens under it. Keep your sign-in email secure and tell us immediately if you suspect unauthorised use. You may not share, sell or transfer your account.

3. Credits, plans and payments

  • Credits are the unit of payment. Processing is charged per second of output video: 1 credit per second for 1080P, 2 for 2K and 3 for 4K, rounded up to the next whole second. The exact cost is shown before you start a task.
  • Free credits. New accounts receive 10 free credits. Results produced before your first purchase carry a small VideoUpscaler watermark.
  • Monthly plans renew automatically each billing period until you cancel. Plan credits are valid for the current and the next billing period; credits that are still unused after that expire. You can cancel at any time from your billing settings; the cancellation takes effect at the end of the paid period and you keep the credits you already have until they expire.
  • Credit packs are one-time purchases. Pack credits never expire while your account is active.
  • Failed tasks. If a task fails because of an error on our side, the credits charged for it are refunded to your balance automatically.
  • Refunds. Because credits are consumed by GPU processing as soon as you use them, purchases are non-refundable except where the law requires otherwise or where we decide, at our discretion, to refund an unused purchase. Contact us if you believe you were charged in error.
  • Prices and taxes. Prices are shown in US dollars and may change; changes apply to future purchases and renewals, not to credits you already hold. Applicable taxes may be added at checkout. Payments are processed by Stripe under its own terms.

4. Your content

You keep all rights to the videos you upload and to the results we produce for you. You grant us a limited licence to store, copy and process your videos solely to provide the service to you, including transferring them to the infrastructure providers named in our Privacy Policy.

You are responsible for the content you upload. You confirm that you own it or have the rights needed to upload and process it, and that it does not violate these Terms or any law.

We do not monitor uploads, but we may remove content and suspend accounts that violate these Terms, and we may cooperate with lawful requests from authorities.

5. Acceptable use

You may not use the service to:

  • upload or process content that you do not have the right to use, including copyrighted material without permission;
  • upload or process content that is illegal, that depicts sexual abuse or exploitation of minors, that is non-consensual intimate imagery, or that harasses, threatens or defames anyone;
  • create deceptive media intended to mislead, defraud or impersonate a real person;
  • distribute malware, attack or overload the service, or try to bypass credit accounting, rate limits, the watermark or other technical protections;
  • access the service with automated tools except through features we expressly provide, or resell the service without our written permission.

6. Intellectual property

The VideoUpscaler website, software, models, design and branding belong to us or our licensors and are protected by intellectual property laws. Except for the licence to use the service and the rights in your own content, these Terms grant you no rights in our property. Our blog articles may be shared with attribution and a link to the original.

7. Availability

We aim to keep the service available but do not guarantee uninterrupted operation. Processing times vary with server load. We may suspend the service for maintenance or for reasons outside our control. Uploaded videos and results are deleted 30 days after processing, as described in the Privacy Policy; download your results promptly and keep your own copies.

8. Termination

You can stop using the service at any time and ask us to delete your account. We may suspend or terminate accounts that violate these Terms, abuse the service or have not been used for a long time, with notice where reasonably possible. Unused free credits are forfeited on termination; purchased credits are handled according to section 3 and applicable law.

9. Disclaimer of warranties

The service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. AI upscaling reconstructs detail from the source video and can produce artifacts; you are responsible for reviewing results before using them.

10. Limitation of liability

To the fullest extent permitted by law, VideoUpscaler is not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or business, arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim arose. Some jurisdictions do not allow these limitations, in which case they apply to the extent permitted.

11. Indemnity

You agree to indemnify us against claims, damages and reasonable costs arising from content you upload or from your breach of these Terms.

12. Changes to these Terms

We may update these Terms. The date at the top shows the latest version. For material changes we will notify you by email or with a notice on the website before they take effect. Continuing to use the service after that date means you accept the new Terms.

13. Disputes

If you have a problem with the service, please contact us first so we can try to resolve it directly. Nothing in these Terms limits the rights you have under mandatory consumer protection law in your country of residence.
